Purposes and legal basis of the processing

The main purposes of the data collected on our forms are recruitment and customer relationship management. They may also be used for statistical or analytical purposes.

 

The Publisher collects and processes the data only with your consent. The information required for processing your file is preceded by an asterisk * (the other information is optional and does not affect the processing of your file).

 

No decisions that have legal effects for Users are taken by exclusively automated processing.

 

In addition, the personal data collected via the Application will be processed by the Publisher in accordance with the Data Recipients.

 

Your data are shared only with authorized persons of the Publisher and of any company belonging to the SAMSIC Group within the meaning of Article L. 233-3 and L. 233-16 of the French Commercial Code in France and abroad, as well as with companies interested in the profile of User Applicants.

 

They may also be legally and securely shared with third parties who help us improve our solutions and services, as well as with sector survey companies, training and social action organizations, subject to a duty of confidentiality.

 

SAMSIC Group undertakes not to transfer or distribute your data to other third parties for the purpose of commercial prospecting.

 

SAMSIC Group may disclose your data to legal authorities if required by law.

In accordance with the legislation on the protection of personal data, you have the right to access, rectify, delete and transfer your personal data and to object to or restrict the processing of your data. For security reasons and to prevent fraudulent requests, this request must be accompanied by proof of identity. After processing the request this proof of identity will be destroyed.

 

You may withdraw your consent to the processing of your data by the SAMSIC Group at any time and without providing a reason.

 

You may at any time refuse to receive any electronic communications.

 

You may also file a complaint with the Commission Nationale de l’Informatique et des Libertés.

 

Security

The Publisher has set up appropriate technical and organizational measures designed to protect your personal data against accidental loss or unauthorized access, use, alteration or disclosure. Despite these measures, the Internet remains an open system and the Publisher cannot guarantee that unauthorized third parties will not be able to circumvent the measures set up or use personal data for unlawful purposes.

 

Article 2 – Access to the Application

Access to the Site is restricted to adults or the legal representatives of minors with parental authority. The Publisher reserves the right to request proof of your age.

 

Access to and use of the Application is reserved for strictly personal use. You agree not to use the Application and the information or data contained therein for any commercial, political or advertising purposes or for any form of commercial solicitation, including sending unsolicited e-mails.

 

You acknowledge that you have the computer equipment including the internet browser and the connection necessary to access the Site in accordance with the required specifications below:

Article 3 – Intellectual Property – Protection of Content

All trademarks, photographs, texts, comments, illustrations, animated or still images, video sequences, sounds, as well as all computer applications that may be used to play the Media and more generally all elements reproduced or used on the Media are protected by the intellectual property laws in force.

 

They belong to the Publisher and/or any companies belonging to the SAMSIC Group or its partners, contractors or suppliers. Any reproduction, representation, use or adaptation, in any form whatsoever, of any of these elements, including computer applications, without the prior written consent of the Publisher or the rights holder is strictly prohibited, with the exception of downloading, displaying and printing for private non-commercial purposes.

 

You may only use the Application to access the Services for private, non-commercial purposes.

 

In particular, you expressly acknowledge and agree that the use of automated systems or software to extract data from the Application, in particular any content (including but not limited to screen shots, screen scraping and web scraping), for any purpose whatsoever, commercial or otherwise; is strictly prohibited, unless an operating licence agreement has been concluded with the Publisher or rights holder. The Publisher’s failure to initiate proceedings as soon as it becomes aware of these unauthorized uses does not constitute acceptance of said uses and waiver of prosecution.

 

In accordance with Article L. 122-4 of the French Intellectual Property Code, any representation, reproduction, extraction, or exploitation not expressly authorized by the Publisher or the rights holder, in whole or in part, whether free of charge or not, and by any means whatsoever of at least one element of the Application, is illegal and constitutes an infringement punishable by articles L. 335-2 and following of the French Intellectual Property Code.

 

Article 4 – Liability

The Publisher, its legal representatives, officers and/or employees, shall not be held liable for any damage whatsoever resulting from logging in to and/or using the Application and/or any Services.

 

Hardware / login data

The equipment you use to log in to the Application is under your sole responsibility. You must take all appropriate measures to protect your equipment and your own data, in particular from Internet virus attacks. You are also solely responsible for the websites, applications and data you view.

 

You are responsible for the browser used to access the Application and Services. It is your responsibility to ensure (i) that the configuration of your operating system and the browser is secure and (ii) that the cache memory of your browser has been cleared so that the accessible pages are up to date.

 

The Publisher automatically holds certain data about Users of the Application, such as the Internet Protocol (IP) address of your computer, the IP address of your Internet service provider, the date and time of access to the Application, the Internet address of the website from which you are redirected to the Application, the operating system you are using, the pages you access, and the information you post or download from the Application. These data may be used for system administration as well as to improve the Services in compliance with Article 5 of the ToU on privacy and personal data protection.

 

Confidentiality of user names and passwords

The Publisher, its legal representatives, officers and/or employees, shall not be held liable for any damage whatsoever resulting from logging in to and/or using the Application and/or any Services.

 

The Publisher may provide you, for the use of certain Services, with a user name and password to log in to the service. Similarly, in accordance with Article 4, you choose your login details when creating your Account. These user names and passwords are strictly personal, non-transferable and confidential and are placed under your responsibility. Please do not share your login details with others, in order to keep your professional and personal data confidential as well as the information accessible by the service.

 

Any access to or use of the Services made using your login credentials shall be deemed to have been carried out by you. Consequently, you undertake not to share your login details with anyone else. You remain solely responsible for the use of your login credentials and undertake to take all necessary measures to keep them confidential.

 

If the Publisher has any reason to believe that the login credentials have been misused and more generally for the purpose of ensuring the security of the Application, the Publisher reserves the right, at any time, without prior notice and without this entitling you to compensation for damage, including loss of profit, business or opportunity, to suspend and/or delete any login credentials and block access to the Application. It is the Publisher’s responsibility to inform you of the interruption to your account if your login credentials have been misused.

 

Without prejudice to the foregoing, you undertake to inform the Publisher without delay of any unauthorized use by a third party of your login credentials of which you are aware and of the circumstances that contributed to such use. In addition, you undertake to actively cooperate with the Publisher to put an end to this unauthorized use.

 

The Publisher shall not be held liable for the use of the Services by a third party in possession of your login credentials.

 

Application Content

The information and data made available via the Application are provided for information purposes only and do not constitute legal and/or operational counsel or engage the liability of the Publisher.

 

You are reminded of the risks inherent in the electronic transmission of information. Delays, omissions or inaccuracies may occur. The information accessible via the Application is provided as is, regardless of its source.

 

The Publisher reserves the right to remove any content posted by you on the Application and which, in its sole discretion, may infringe any third party right.

 

The Publisher cannot be held liable in the event of legal proceedings against you:

– as a result of the use of the Application or any service accessible via the Internet;

– as a result of your failure to comply with the ToU.

 

The Publisher is not liable for any damage caused to you, third parties and/or your equipment as a result of your connection or use of the Application and you waive any claim against it arising therefrom.

 

Should the publisher become subject to an amicable or legal proceeding as a result of your use of the Application, it may seek compensation from you for all damages, sums, convictions and costs that may arise from this proceeding.

 

Confidentiality of communications via the Internet and other networks

The Publisher does not guarantee secure transmission of information, data and documents of any kind between the Publisher and you. The Publisher is not responsible for any interception, hacking or theft of such information by a third party during its transmission.

 

Availability

The Application is, in principle, accessible 24 hours a day, 7 days a week, barring scheduled or non-scheduled interruptions for maintenance, updating or in cases of force majeure. This is a best efforts obligation on the part of the Publisher, who cannot be held liable for any damage resulting from the unavailability of the Application.

 

Proof, storage and archiving

You and the Publisher acknowledge, under the proof agreement in accordance with Article 1316-2 of the French Civil Code, that the computer records kept in the Publisher’s systems in compliance with the best security practices will be considered as probative evidence of electronic mail communications, registration forms sent, documents downloaded, acceptances, subscriptions to services and orders placed. These documents and data are archived on a medium designed to ensure the integrity and the faithful and durable character required by the legal provisions in force. It is agreed that in the event of any discrepancy between the computer records held by the Publisher and any documents in any format (paper, electronic or other) in your possession, the Publisher’s computer records shall prevail.

 

The archiving and conservation of the electronic documents contained in the Digital Safe are ensured by Primobox and are not the responsibility of the Publisher.

Article 5 – Hypertext links

You are strictly prohibited from setting up any hypertext links to the Application without the prior written authorization from the Publisher, requested by email with read receipt to the following address:

The Publisher is free to refuse this authorization without having to justify its decision. If the Publisher grants its authorization, it is specific and only temporary and may be withdrawn at any time, without any obligation of justification on the part of the Publisher.

 

All links must be removed upon simple request of the Publisher, made via any method.

 

All information accessible on the Application via a link to other sites or Applications is not under the control of the publisher, who declines all liability for their content.

 

Article 6 – Cookie Policy

When you access and use the Application, information is temporarily stored in memory or on your hard disk, by means of cookies.

 

The Publisher’s cookie policy is detailed below.

 

You can read this cookie policy by clicking on the information box that is displayed when connecting to the Application. You are then redirected to the file of these ToU containing the following cookie policy.

 

By clicking on “Accept” in the information box provided for this purpose when connecting to the Application, you acknowledge that you have been informed of the policy on the use of cookies and confirm that you authorize the Publisher to collect cookies.

 

All information collected indirectly will be used only to track the volume, type and configuration of traffic using the Application, to develop its design and layout and for other administrative and planning purposes and more generally to guarantee and improve the service we offer you.

The photographs and representations of any nature whatsoever appearing on the Application associated with the Services, together with their description, are not contractual and are not binding on the Publisher.

 

Article 8 – Applicable law

The ToU are written in French, which is their language of interpretation.

 

The ToU are governed by French law and fall within the jurisdiction of the courts of RENNES, subject to a specific attribution of jurisdiction arising from a particular law or regulation.
